1. Introduction

Welcome to INKED by Jackie. These Terms and Conditions (“Terms”) govern your use of our website located at www.inkedbyjackie.com (the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Intellectual Property Rights

Unless otherwise stated, INKED by Jackie and/or its licensors own the intellectual property rights for all material on the Site. All intellectual property rights are reserved. You may access this from the Site for your own personal use subjected to restrictions set in these terms.

You must not:

  • Republish material from the Site without credit.

  • Sell, rent, or sub-license material from the Site.

  • Reproduce, duplicate, or copy material from the Site for personal or commercial purposes.

3. User Accounts & Responsibilities

If you create an account on our Site, you are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account. We reserve the right to terminate accounts or remove content at our sole discretion.


4. Acceptable Use

You agree not to use the Site in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the Site. You shall not use the Site for any fraudulent or harmful activity, including but not limited to the distribution of viruses or unauthorized scraping of data.


5. Disclaimer of Warranties

In accordance with Massachusetts law, this Site is provided "as is" and "as available." We make no representations or warranties of any kind, express or implied, as to the operation of the Site or the information, content, or materials included on this Site.


6. Limitation of Liability

To the maximum extent permitted by applicable law, INKED by Jackie shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Site.

Note for MA Residents: Massachusetts law provides certain protections under Chapter 93A. Nothing in these Terms is intended to waive any non-waivable statutory rights you may have as a consumer in the Commonwealth of Massachusetts.


7. Payments, Refunds, and Cancellations


7.1 All Sales Final

Due to the digital and/or custom nature of the products and services provided on this Site, all sales are final. You acknowledge and agree that once an order is placed, or a digital product is delivered or accessed, there are no cancellations, returns, or refunds under any circumstances.


7.2 Cardholder Representation and Authorization

By providing payment information, you represent and warrant that:

  • You are the authorized owner of the payment method provided, or you have received express, documented permission from the cardholder to perform this transaction.

  • You authorize INKED by Jackie to charge the full amount of your purchase to the designated payment method.

  • Personal Liability: If you use a payment method that is not in your name and the transaction is later disputed by the cardholder or financial institution, you remain personally and fully liable for the total purchase price. You agree to indemnify INKED by Jackie for any losses, including the original sale amount, chargeback fees, and administrative costs.


7.3 No Chargebacks

By making a purchase, you acknowledge that you have read and agreed to our "All Sales Final" policy. You agree that you will not initiate a "chargeback" or payment dispute with your bank or credit card issuer for any legitimate charge.


7.4 Consequences of Unauthorized Disputes

If you initiate a chargeback or payment dispute for a purchase that was authorized and delivered as described:

  • You agree to be liable for all costs incurred by INKED by Jackie in responding to and/or defending the dispute, including but not limited to bank fees, merchant processing fees, and reasonable attorney’s fees.

  • We reserve the right to report fraudulent or bad-faith disputes to relevant credit reporting agencies.

  • We reserve the right to immediately terminate your access to any digital products, services, or future purchases.


8. Printing and Output Disclaimer


8.1 Recommendation for Quality:

To ensure the highest quality output, INKED by Jackie has vetted and recommends the use of Prints of Love for all digital printing.


8.2 No Guarantee on Third-Party Printing:

While we provide high-resolution files designed for professional printing, we cannot and do not guarantee the final print quality, color accuracy, or alignment if you choose to use a different printing service, home printer, or third-party software.

  • Colors may vary significantly between monitors and different printing hardware.

  • INKED by Jackie is not responsible for any printing errors, including but not limited to: blurry images, color shifts, incorrect sizing, or paper quality issues resulting from the use of non-recommended vendors.



8.3 No Refunds for Printing Issues:

As stated in Section 7, all sales are final. We do not offer refunds, reprints, or complimentary file revisions due to poor results from a third-party printer or home printing setup. You are solely responsible for verifying the proof with your chosen printer before committing to a full print run.


9. Governing Law & Jurisdiction

These Terms will be governed by and interpreted in accordance with the laws of the Commonwealth of Massachusetts. You submit to the exclusive jurisdiction of the state and federal courts located in Massachusetts for the resolution of any disputes.


10. Changes to Terms

We reserve the right to revise these Terms at any time. We will notify users of significant changes by posting a notice on our homepage or via email. Your continued use of the Site after changes are posted constitutes your acceptance of the new Terms.
